Our client was a derivative on an I-485 application and had previously worked in the US without authorization. Since the basis of the I-485 was employment based, attorney Furqan Azhar argued that he was still eligible to adjust based on 245(k), since that work did not exceed 180 days. USCIS approved the I-485 without an RFE.
